These Terms of Service (“Terms”) govern your access to and use of Neby AI (the “Service”), operated by OF Finance (“Our Family Finance”, “we”, “us”) at ai.of-finance.io. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Neby AI is an AI-powered assistant focused on the OF Finance earnings model. It can answer questions, help with calculations, and engage in conversation. The Service is provided for informational and general assistance purposes only.
2. Accounts
- Accounts are created and issued through our provisioning system; there is no public self-service sign-up.
- Each account has a limited validity period (currently 30 days) and a usage budget. Once the validity period ends or the budget is exhausted, access may stop until a new account is issued.
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- You must not share, resell, or transfer your account, or attempt to access another user’s account or data.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Attempt to extract, reverse-engineer, or bypass the Service’s system instructions, safeguards, models, or configuration, or interfere with its security.
- Probe, scan, or test the vulnerability of the Service without authorization.
- Use automated means to access the Service in a way that places an unreasonable load on our systems or circumvents usage limits.
- Upload malware, or content that infringes the rights of others or violates the law.
- Use the Service to generate content that is illegal, abusive, or harmful to others.
We may suspend or terminate access for any violation of these Terms.
4. Your content
You retain ownership of the messages and files you submit (“Input”). You grant us a limited license to process your Input solely to operate and provide the Service, including sending it to our AI provider to generate responses. You are responsible for your Input and confirm you have the right to submit it.
5. AI output — no professional or financial advice
Responses are generated by an AI model and may be inaccurate, incomplete, or out of date. The Service does not provide financial, investment, legal, tax, or other professional advice, and nothing it produces should be relied upon as such. Any earnings figures, estimates, or calculations are illustrative only and are not a promise or guarantee of results. You are solely responsible for any decisions you make based on output from the Service. Verify important information independently before acting on it.
6. Third-party services
The Service relies on third-party providers (including Google’s Gemini AI service) to function. Your use of the Service may also be subject to those providers’ terms. We are not responsible for the availability, accuracy, or practices of third-party services.
7. Availability and changes
We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We may also update these Terms; when we do, we will revise the “Last updated” date above. Continued use after changes take effect means you accept the updated Terms.
8. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the maximum extent permitted by law, OF Finance and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Service.
10. Termination
We may suspend or terminate your access at any time if you violate these Terms or to protect the Service. Upon termination, your right to use the Service stops immediately. Provisions that by their nature should survive termination (such as disclaimers and limitation of liability) will survive.
